1. Acceptance of Terms
By accessing or using the Samudra Oceans platform and website (the Service), you agree to be bound by these Terms of Use. If you are accessing the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these terms. If you do not agree to these terms, you must not use the Service.
2. Use of the Service
You may use the Service only for lawful purposes and in accordance with these terms and any applicable customer agreement. You must not use the Service to transmit any unlawful, infringing, harmful, or fraudulent content; attempt to gain unauthorised access to any part of the Service or its infrastructure; reverse-engineer, decompile, or extract source code; or resell or sublicense access without our written consent.
3. Intellectual Property
All intellectual property in the Service, including software, data models, algorithms, ocean intelligence datasets, reports, and documentation, is owned by Samudra Oceans Ltd or its licensors. Your use of the Service does not grant you ownership of any content or intellectual property. You retain ownership of any data you submit to the platform, and grant us a limited licence to process it to deliver the Service.
4. Limitation of Liability
To the fullest extent permitted by applicable law, Samudra Oceans Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability for any claims arising under or in connection with these terms shall not exceed the fees paid by you in the twelve months preceding the claim.
5. Disclaimer of Warranties
The Service is provided on an as-is and as-available basis. While we use reasonable efforts to maintain accuracy and availability, we make no warranties, express or implied, regarding the completeness, accuracy, reliability, or fitness for a particular purpose of any ocean intelligence data, outputs, or recommendations provided through the platform. Users should apply their own professional judgement when acting on platform outputs.
6. Termination
We reserve the right to suspend or terminate your access to the Service immediately if you breach these terms, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in force.
7. Governing Law
These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer protection rights that may apply in your jurisdiction.
